Pad Update Policy

Your PAD file that is submitted will be periodically checked on a random basis to determine if your PAD file is current and continues to follow the submission agreement. The randomness will usually be more frequent than every seven days, but to maintain randomness and not excess strain on servers hosting your PAD file, it may be up to 14 days. The time of day will also be random to ensure that your PAD file can be accessed at any time, even during strained times.

In addition to checking to see if you PAD file continues to exist we will check

Check that your PAD file can be accessed by the server. We may delete your file on the first time that your PAD file is not reachable if there have been other problems with your submission. Otherwise it will be three strikes and you are gone. We will generally not send warnings, unless there is a reason too.

Check that all PAD elements exist. (See Below)

Ensure that the release date has not changed to a date in the future. DO NOT try to change your PAD to get to the front of the new releases.

Content is unchanged. If you submit a game, do not change it to a screen saver. You will be permanently barred from submissions if you do this.

If your web site is active and your PAD is not active, your PAD will be deleted.

If a company has been banned and has been taken over by a second company, both companies PAD files will be deleted and barred.

Anyone changing their PAD file after successfully submission to try and rank higher in the order may be grounds for company termination from submissions.

Limitation of Liability NOTWITHSTANDING ANYTHING ELSE HEREIN, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, INCLUDING, BUT NOT LIMITED TO, TORT, CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, SHALL "TWO BROTHERS SOFTWARE, LLC." OR ITS LICENSORS, OR SUBLICENSORS, BE LIABLE TO YOU OR ANY OTHER PERSON (I) FOR ANY PUNITIVE, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, COMPUTER FAILURE OR MALFUNCTION, OR DAMAGES RESULTING FROM YOUR USE OF THE SOFTWARE OR THE SERVICES PROVIDED BY "TWO BROTHERS SOFTWARE, LLC." OR (II) FOR ANY MATTER BEYOND "TWO BROTHERS SOFTWARE, LLC." OR ITS LICENSOR'S REASONABLE CONTROL. "TWO BROTHERS SOFTWARE, LLC."'S AND ITS LICENSOR'S MAXIMUM LIABILITY FOR DAMAGES OF ANY KIND WHATSOEVER ARISING OUT OF THIS AGREEMENT SHALL BE LIMITED TO (I) 50% OF THE PURCHASE PRICE PAID BY YOU FOR THE SOFTWARE OR SOFTWARE LISTING OR (II) IF YOU RECEIVED THE SOFTWARE OR SOFTWARE LISTING FREE OF CHARGE ON A TRIAL BASIS, ZERO DOLLARS ($0.00), EXCEPT WHERE NOT PERMITTED BY APPLICABLE LAW, IN WHICH CASE TWO BROTHERS SOFTWARE'S LIABILITY SHALL BE LIMITED TO THE MINIMUM AMOUNT PERMITTED BY SUCH APPLICABLE LAW. THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF "TWO BROTHERS SOFTWARE, LLC." HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. This Agreement shall be governed by and construed under Wisconsin law.

This site requires PAD file format version 1.1 or later. PADGen version 1.2 or later supports this format.
